1-Who we are

“Arts Of Heart” is a judgment-free local Platform for creative minds from all walks of life. It is a free Gallery-Shop where all the tools are made available to catalog, share, discuss and sell your creative work locally and nationwide.     Our website address is: https://www.artsofheart.com, our mobile apps version, and the other services provided by “Arts of Heart” platform  (we will refer to all of these collectively as our “Services”).

“Arts of Heart” welcomes you. Relax and have fun, but please be respectful of our rules.

2-TERMS OF USE

*Don’t Use Our Services to Break the Law.

You assure that you will not be in violation of any laws in connection with your use of our services. This includes any local, state, federal, and international laws that may apply, such as the obligation to acquire any permits or licenses that your shop requires and the obligation to abide with local, state, federal, and international property possession laws. In addition to selling your items, you will also deliver them. Measures such as verifying parental consent before delivering anyone under the age of 13, You may not sell anything that violates any of the laws; you must abide by our Sanctions Policy, and you are prohibited from engaging in fraud (including false claims and infringement notices), theft, anti-competitive conduct, threatening conduct, any act contrary to ArtsofHeart.com laws, another ArtsofHeart.com user, or a third party,…etc.

ArtsofHeart.com Services unite people all over the world who are able to share, buy and sell their Creative products that no one else possesses. Here s a handy guide to assist you understand the specific rules that apply to your specific usage of the Services, based on your use.

3-Termination

a)-INITIATED BY YOU

We would not want for you to leave ArtsofHeart.com, but you may cancel your account at any time from your Artsofheart.com account. Read more information regarding terminating your account within this Help article. Terminating your subscription is no guarantee that other content you published through the Service will remain complete. And you still must pay outstanding payments for those services if any by the time of account deletion.

b)-INITIATED BY US

We may cancel or suspend your account (and any related accounts Artsofheart.com determines), and it s important for you to understand that you are no longer able to access and use our Services if we

determine that you have violated our Terms. If we do so, it s important to understand that it does not constitute a breach of contract or are grounds for you to pursue legal action, it is only the execution and application of the rules and policies agreements as stipulated in these collective and specific terms of use and agreements.

Artsofhearts.com generally sends the notice to your account if your account has been terminated or suspended, unless we have a reason prohibiting us from notifying you or you have breached our Terms and Conditions on a number of occasions.

c)-WE RESERVE THE RIGHT

Artsofheart.com might change, terminate, or discontinue any of the Services or even some or all of the Services for you, any or all users, at any time. “Arts of Heart” won’t be liable for the way that any changes to the Services will affect you, including your income or ability to generate income via the Services…. and others.

d)-SURVIVAL

Note that this Terms will continue even after your access to this Service is terminated, or your use stops.

4-Third-Party Services

Our Services may contain links to third-party websites or other goods or services that we do not own or control (such as links to social media sites such as Facebook and Twitter, and links to third-party mobile-screen-cleaning services). You may also need to use a third-party service to use some of our Services (like a compatible mobile device for our use of our mobile apps). In such cases, the third parties may require you to follow their terms of service. “Arts of Heart” is not a party to those agreements; it’s solely a relationship between you and the third party.

a)-Don’t Try to Harm Our Systems.

You agree not to attempt to interfere or disrupt our services, such as by distributing a virus, overly numerous requests to our platform or web site, or harmful computer programs.

5-Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

6-Cookies

 If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

For example, if there is an error in a seller s computer system that causes the seller’s name and email address to get out, the seller rather than “Arts of Heart” will be held accountable for that.

ArtsofHeart.com and sellers are joint data controllers of buyers’ personal information. If you determine how things happened as a joint data controller of buyer information, you agree to indemnify Arts ofHeart for the expenses it incurs.

ArtsofHeart.com Indemnification /What Happens If You Get Us Sued:

No matter what happens to Artsofheart.com (including any of its personnel), you agree to defend and indemnify us. This sets you up to defend Arts of Heart as well as hold us harmless from any lawsuit demand or action (including attorney’s fees) that arises from your actions, your use of our services, your violation of the Terms, or anything related to you, or your account committing a breach of someone else ‘s rights.

If we decide to use our legal defense, even if you have insurance to cover damages, you must cooperate with us so we can defend ourselves from related harm.

If you think you are entering into an online dispute with a user of Arts of Heart Services or with an outside source, we strongly encourage you to attempt to resolve the dispute amicably.

11-Case Settlement System

Customers and parties who are unable to make a determination with respect to a transaction on our websites or mobile applications can submit a case to our case system.

Artsofheart.com will do our best to resolve disputes in accordance with our understanding and interpretation of our policies. ArtsofHeart.com doesn’t have to make any judgment call on legal issues or claims.

12-Warranties and Limitation of Liability -{Things You Cannot Sue Us For}

Although Artsofheart.com is not a manufacturer, store owner, or inspector for the items sold through its Services, we offer the venue for which these items were listed, advertised and sold. Since ArtsofHeart.com is not affiliated with any items sold through our marketplace, we cannot make warranties with respect to quality, safety, authenticity, or legality of those products.

Legal claims relating to an item you purchased must be brought directly to the vendor of that item. You can opt against ArtsofHeart.com from any claims relating to items sold by our sellers (for instance, for damaged items, misrepresentations by sellers, or items that led to physical injuries). You therefore release ArtsofHeart.com from any claims related to products sold through our services.

Various things you note may possibly become objectionable or offensive, thus we make no representations concerning the information uploaded by users within the Services. We don’t contain any representations pertaining to the information uploaded through the Services by users. Regarding any content uploaded to ArtsofHeart.com through  our Services, ArtsofHearts.com  doesn’t declare any type of guarantee or commitment for the total regard control, morals, or lawfulness of these articles. You relieve us of all liability for that piece of information.

14-People You Interact With.

Artsofheart.com  Services let you interact with others in person or online. However, we affirm that we are not responsible for the monitoring or screening of users of the Services, nor for any interactions between you and other third party users of our services. In other words, you release us from any liability concerning your interactions with other users of our services.
